Agreement
These Terms govern your use of thevikalp.com and the services operated by The Vikalp ("we", "us"): Refine, The Vikalp Form, and this website. By creating an account or using a service, you agree to these terms.
The Vikalp operates from Churi, Banethi, Kotputli-Behror, Rajasthan 303105, India.
Accounts
- Provide accurate information and keep your credentials secure.
- You are responsible for activity under your account.
- Minimum age: 18, or with verifiable consent of a parent/guardian.
Acceptable use
You must not:
- Upload or share content that is illegal, infringing, or harmful to minors.
- Attempt to access other users' data, scan or probe our systems without written permission.
- Use face search features on people who have not been informed their photos are being processed in the album context.
- Resell or commercially redistribute service output (e.g. embedding results) as a competing product.
- Circumvent rate limits, quotas, or abuse protections including captchas.
We may suspend accounts violating these rules, with notice where practicable.
Your content
- You retain all rights to content you upload ("your content").
- You grant us a limited license to store, process, and display your content solely to operate the service you chose (including computing face embeddings for Refine's search when enabled).
- You can delete your content at any time; deletion removes it from production systems within 30 days.
- We may remove content when required by law or a valid takedown notice (see our DMCA policy).
Our services
- Services are provided "as is" and "as available". We work hard on reliability but do not warrant uninterrupted or error-free operation.
- Features in beta are labelled as such and may change or be discontinued with reasonable notice.
- We may ship updates that change functionality, provided core promised features keep working.
Paid tiers
If a service offers paid tiers, the specific price, billing cycle, and refund terms shown at purchase apply, together with our Refund Policy and Shipping & Delivery disclosure.
Limitation of liability
To the maximum extent permitted by law, The Vikalp is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of the services. Our aggregate liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
Termination
You may stop using services and delete your account at any time. We may terminate or suspend accounts for material breach of these terms, with notice where practicable. On termination, the retention rules in our Privacy Policy apply.
Governing law and jurisdiction
These terms are governed by the laws of India. Courts at Jaipur, Rajasthan have exclusive jurisdiction over disputes arising from these terms or the services.
Changes
We may update these terms; material changes are announced on this page with an updated date at least 14 days before they take effect for existing users.
