Our position
The Vikalp hosts user-generated content: photo albums and files on Refine, and form content collected through The Vikalp Form. We respect copyright law and respond to clear notices of alleged infringement.
We operate from Churi, Banethi, Kotputli-Behror, Rajasthan 303105, India. This procedure follows the notice-and-takedown pattern of 17 U.S.C. Section 512 (DMCA), which most hosting providers and advertising networks recognise internationally, alongside applicable Indian copyright law (Copyright Act, 1957, including Section 52 safe-harbour provisions for intermediaries).

Filing a takedown notice
Your notice must include all of the following:
- Identification of the copyrighted work you claim is infringed.
- The exact URL(s) on our services where the material appears.
- Your full name, address, phone number, and email.
- A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorised to act for the owner.
- Your physical or electronic signature.
Notices missing required elements may be rejected; we will tell you what was missing when practicable.
What we do
- Acknowledge valid notices within 3 working days.
- Remove or disable access to allegedly infringing material within 5 working days of validation, where technically feasible.
- Notify the affected user with a copy of the notice.
- Refile-compliant notices after correction instead of ignoring them.
Counter-notification
If your content was removed and you believe it was misidentified or authorised, send a counter-notice to the same address with subject "DMCA Counter-Notice":
- Identification of the removed material and its previous location (URL).
- Your name, address, phone, email.
- A statement under penalty of perjury that you have a good-faith belief the removal resulted from mistake or misidentification.
- Consent to the jurisdiction of courts in your district (or, if outside India, of any judicial district where we are found), and agreement to accept service of process from the original complainant.
On receiving a valid counter-notice we forward it to the complainant. If they do not notify us within 10 working days that they filed a court action, we restore the material where feasible.
Repeat infringers
Accounts subject to repeated valid infringement notices are terminated. We maintain internal records of validated notices per account.
Abuse of this process
Knowingly filing false notices or counter-notices may make you liable for damages, costs, and attorney fees under applicable law.
